WILLS and POWER of ATTORNEY

It is advisable that everyone should have a will, and appoint an executor in order to have control over the distribution of his or her property.  When you start your plan, there’s a lot to think about.  You want to live your life to the fullest, and ensure that your heirs will get the most out of the assets you’re setting aside for them.

 

There are three basic documents that form the foundation of an Estate Plan: a Will, an Enduring Power of Attorney,  and a Personal Directive.

The cornerstone of estate planning is the Will.  A living will sets out directives concerning end of life decisions, whereas a durable power of attorney gives all medical decision making authority to an appointed individual upon incapacity, including end of life decisions. Some people have both a living will and a health care power of attorney.   Specific final arrangements, such as whether to be buried or cremated, are also often part of the documents..

  It is also advisable that a qualified person be appointed as Power of Attorney who is not necessarily your executor. This appointment gives that person the right to make decisions on your behalf should you become incompetent. Remember that having a will and appointing a Power of Attorney is an expression of concern for the well being of those you love.
